These Terms of Service ("Terms") govern the marketing website axisforge.tech and outline the general engagement terms under which Axisforge GmbH ("Axisforge", "we", "our", or "us") provides cloud architecture and systems engineering consulting services to clients. By browsing our website or submitting an intake request, you acknowledge that you have read and agreed to these terms.
Axisforge supplies specialized cloud architecture review, database scaling, platform engineering, and infrastructure optimization consulting. The specific deliverables, schedules, and milestones of any project will be defined in a separate Statement of Work (SOW) signed by both parties. We do not provide software development or systems administration services outside the scopes detailed within signed SOW agreements.
Our status is that of independent professional consultants. We are not employees, agents, or legal representatives of our clients. Our advisory recommendations represent our professional engineering judgment based on systems parameters supplied by the client. We do not guarantee specific server uptime metrics or business margin outcomes, as operational results depend on software modifications and third-party cloud service availability outside our control.
For Axisforge to execute audits and configuration migrations, clients must provide read-only diagnostic access to cloud accounts, database connection statistics, and relevant code repositories. Clients are responsible for ensuring that all data backups are completed and verified before any infrastructure migrations are initiated. Axisforge is not liable for data loss occurring due to client backup configuration failures.
We treat all client system blueprints, transaction volume details, database logs, and proprietary code repositories as strictly confidential. We do not share client information with third parties unless required by law or explicitly authorized in writing. This confidentiality rule survives the termination of any consulting engagement.
Unless agreed otherwise in a signed SOW, all custom Terraform configuration modules, deployment scripts, and architecture reports written specifically for the client during an engagement become the property of the client upon receipt of full payment. Axisforge retains the rights to generic, open-source script libraries and engineering design patterns developed prior to or independently of the engagement.
To the maximum extent permitted by German law, Axisforge's liability for any losses, database downtime, or security incidents arising from our consulting services is limited to the total fees paid by the client under the specific SOW associated with the incident. We are not liable for indirect, consequential, or punitive damages, including lost business profits or data corruption, under any circumstances.
These Terms, as well as all business engagements between Axisforge and its clients, are governed exclusively by German law. The place of jurisdiction for all disputes arising from our services or this website is Berlin, Germany.
We reserve the right to modify these Terms at any time. Any changes will be published directly on this page with an updated modification date. Your continued use of our website or services following updates indicates your approval of the revised terms.
